Paternity Leave

As provided for by Republic Act No. 8187, a married male employee is entitled to a paternity leave benefit of seven (7) working days, with full pay for the first four (4) deliveries by his lawful spouse.  This also covers miscarriages.  This leave is granted in recognition of the husband’s role at the time of his wife’s confinement and the baby’s care.    Requirement:  Photocopy of the Medical Certificate of the wife.

The Expanded Maternity Leave Law (RA 11210 s. 2018) allows any female employee who will avail of the maternity leave to transfer up to seven (7) of her 105 days of paid leave to the child’s father whether they are married or not.  In effect, this measure increases the paternity leave with pay to a maximum of 14 days.
